Rose has a broad practice with a focus on common law, class actions, inquests and public law.

Matters in which Rose has particular speciality and experience include:

  • negligence and intentional tort claims (particularly those involving the intersection of the exercise of public power and tortious liability);
  • coronial inquests and public inquiries;
  • disciplinary proceedings and professional negligence matters;
  • sensitive proceedings involving disputes about public interest immunity, client legal privilege and suppression orders; and
  • quasi-criminal matters, such as proceedings under the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997 and Serious Offenders Act 2018.

Class actions

McNickle v Huntsman Chemical Company (Roundup Class Action) (led by Jack Rush QC, Andrew Clements QC, Melanie Szydzik and Rebecca Howe, for the Applicant and the class) - Federal Court class action involving negligence and safety defect claims in relation to Roundup products.

Professional negligence

Greensill v Piper Alderman & Ors (led by Peter Cawthorn KC, for law firm defendant) – alleged failure to advise in relation to a malicious prosecution claim; interlocutory application (unled) [2022] VSC 622

Common law (tort)

Riddle v State of Victoria; Trickey v State of Victoria; Beyer v State of Victoria (led by Robert Heath QC and Roslyn Kaye, for the State of Victoria) – multiple Supreme Court proceedings involving claims of negligence and occupier’s liability relating to alleged organochlorine pesticide soil contamination at secondary school.

Dani Laidley v State of Victoria (led by Sam Hay QC, for the State of Victoria) – Supreme Court proceedings involving claims in negligence, misfeasance in public office and breach of confidence against Victoria Police.

Various police tort proceedings involving claims for negligence, battery, assault and malicious prosecution.

Coronial inquests

Inquests into the deaths of Wills, Polden and Ibrahim (led by Ben Ihle QC, for the Chief Commissioner of Police) - inquest relating to double homicide and subsequent police shooting.

Inquest into the death of Jacqueline Vodden (unled, Counsel Assisting the Coroner) - police pursuit inquest.

Inquest into the death of Charles Squires (unled, for the Department of Justice and Community Safety) - death in custody inquest.

Inquest into the death of Micky Revera (unled, for the Chief Commissioner of Police) - death in custody inquest.

Inquest into the death of Darren Fielding (unled, Counsel Assisting the Coroner) - death in custody inquest.

Advice

Rose has undertaken a wide variety of advice work (both led and unled) including in relation to public interest immunity, tortious liability, the exercise of public powers and statutory interpretation.

Before coming to the Bar, Rose was a Principal Solicitor at the Victorian Government Solicitor’s Office, where she had carriage of high profile and sensitive proceedings on behalf of government clients. Before this, Rose worked in the Trials Chamber of the United Nations International Criminal Tribunal for Rwanda and Center for Death Penalty Litigation in North Carolina.
