Ben practises predominately in common law and administrative law.

His experience includes appearing and advising in relation to medical liability claims, disciplinary proceedings, coronial inquests, judicial review proceedings, personal injuries matters and professional negligence proceedings.

Ben has been briefed to appear and advise in the full spectrum of medical liability claims including, amongst others, wrongful birth claims, nervous shock arising out of the death of a patient, infectious diseases, emergency medicine, orthopaedics, obstetrics, matters involving a failure to diagnose, informed consent cases and matters involving privacy and health records. He has also appeared in matters involving institutional abuse, industrial accidents, transport accidents and public liability.

Some matters in which Ben has appeared as counsel include (non-exhaustively):

  • The COVID-19 Hotel Quarantine Inquiry (led by C Harris QC & Ors on behalf of the State of Victoria);
  • The St Basil’s Inquest (led by M Hartley QC & Ors on behalf of the State of Victoria);
  • Inquest into the death of Maria James (led by C Winneke QC & Ors on behalf of the family);
  • Villan v the State of Victoria [2021] VSC 354 (led by M Britbart QC on behalf of the State of Victoria);
  • Perez v Reynolds & Anor [2020] VSC 537 (led by M Britbart QC on behalf of the State of Victoria);
  • Numerous professional disciplinary proceedings, including on appeal in relation to the interpretation of Section 156(1)(a) of the Health Practitioner Regulation National Law.

Prior to joining the Bar, Ben was a Senior Associate at MinterEllison in the insurance and corporate risk team where he acted on behalf of a range of insurers, government agencies and public/private hospitals in insurance and personal injuries proceedings.

Ben read with Robert Harper and his senior mentor was Jack Rush QC.

Ben is a member of the Common Law Bar Association.
